I wrote and posted an article on the legalities of escorting in Canada. You can read it here.

This article is intended to help escorts make informed decisions on how to conduct their business so as to manage their legal risks specifically with respect to Canadian law, and to help hobbyists understand why escorts work the way we do in Canada.

The bottom line is that private outcall sexwork between consenting adults is legal, but there a number of legal landmines to avoid. I hope that the information will be generally useful to all escorts and hobbyists even though the legalities are specific to Canadian law.

You're very welcome, Paul. I'm very glad that you found the info to be useful. US hobbyists that are close to Canadian cities (Seattle/Vancouver, Calgary/Houston, Detroit/Windsor, Buffalo/Toronto) can take advantage of our legal private outcall sexwork between consenting adults.

I mention Calgary/Houston (which might sound strange) because there is a lot of business travelers going back and forth between these two oil centers.

Glad you found it useful Leslie. Similar issues moving from US->Canada as Canada->US. Marriage is very helpful, but it may still take months to be allowed in. Work visas are possible if you have skills in demand and a company that will sponsor you. I think nurses are in demand.

Unfortunately, escorting is not on the 'approved' list. LOL!

Being new to all this I find all this information invaluable, however I am still a little confused about one point.

If I am a customer and I am interested in a particular service, how do I find out if that service is available from one of the very nice ladies that has taken my fancy before I pay for some of her time. That is without putting the escort in a position where she feels uncomfortable or suspicious that you might be LE. But still being able to be reasonably sure that the area of interest may actually be available, (obviously this would be totally out side of the time you would be paying for and not a service but something two consenting adults did )?

Just how do you do this without being blown out or arrested yourself by undercover LE?

In Canada, you can talk frankly and explicitly to her so long as the conversation is conducted in a "private place", not a public place. Be sure you understand the legal definition of a public place which is anywhere the public has a right of access. It specifically includes automobiles (because the law was designed to control street prostitution.). In the situation you describe, a telephone call or email would be private (and they are not a "place".)

Now you still have to ensure that the communication is private to BOTH parties. If you talk to an escort from a cell phone on a street within earshot of a (possibly undercover) LE officer, your conversation is not private. Likewise if you use your company's email system to exchange emails with an escort, you likely do not have a right to privacy for your emails.

This is still difficult. Because undercover LE would present themselves as a potential client, and ask the same kind of explicit questions. Many escorts are themselves not as familiar with the law as they should be, and so they err on the side of caution.

I have two suggestions for Canadian escorts and hobbyists. (This does not apply to any other legal jurisdiction.) When contacting an independent escort that advertises on the internet ... the first is to ask in an unblocked telephone call from a private residence or hotel room. The second is to ask using an encrypted email service. Don't be offended if she chooses not to answer. That's her prerogative.

You make sure that any communication is conducted in a private place. Now, you may still be arrested because LE will charge you with everything they can think of ... all they need is one charge to stick. But they would not be able to make the case for soliciting in a public place.

Well Dominixe I have to say it, smart and smoking hot what a combination!
That information is great and makes total sense, but as I understand it this ONLY applies to Canada.
It's still too bad that LE would still try to slap you with whatever charges they could. I suppose it was the same with prohibition, once it was legal the entire LE started openly drinking the same as everyone else. They really do have more important things to be doing then stopping two consenting adults.

So thanks again great info which should help hobbyists and escorts alike.

Its in the Criminal Code of Canada.

The law, LE and politicians are completely hypocritical. The Eliot Spitzer scandal (in the US) is a testament to that. Here's a governor and former state attorney with the law-and-order image, who's prosecuted prostitution rings and himself is caught using the services of an escort. Notice that the escort was not charged, and is now somewhat of a celebrity. That's because Spitzer was the bigger news story.
